What is an offer agreement?

An offer agreement (offer) for the provision of services is an open and publicly available agreement, officially published in the public domain.

An offer agreement foresees the provision of specific services on the terms outlined within.

As per the terms of said offer, a teacher is considered a service provider and not an employee of the school. As is, this is an independent contractor agreement and not an employment agreement.

The offer, readily available in the teacher’s personal account, is a legally binding document which foresees the provision of services by the teacher and an appropriate remuneration by the school. The offer contains all the relevant terms and conditions of a service agreement.

Below are a few examples of similar offers from other service providers:

The Skyeng offer contains 6 appendices which are indelible from the main body, e.g.,

  1. Teacher Guidelines, which cover the ethical and moral norms as well as the code of conduct that govern interactions between the teacher, their student and the company (Skyeng).
  2. Guidelines on rates and incentives, which cover the terms of remuneration for the services provided.
  3. Guidelines on KPIs, which detail the Skyeng criteria for assessing the quality of services provided by the teacher.
  4. Privacy policy, which governs the protection of personal data.
  5. Privacy agreement.
  6. Terms and conditions for the provision of services, which detail the standards for holding lessons, quality assessment and remuneration. There may be more than one of these appendices if you teach several subjects with varying standards.

 

How do I agree to the offer?

By accepting the offer, you comply with the terms and conditions of the agreement.

As per the terms and conditions of the Agreement, the Offer is considered to be accepted by the Teacher and the Agreement comes into effect in respect of Article 5 of the Agreement once the Teacher creates an account in the Vimbox system. The other terms and conditions of the Agreement are considered to be accepted by the Teacher and the Agreement comes into effect in full on the day of the first lesson held by the Teacher.

At the very start of our cooperation or in case any changes are made to the terms and conditions of the offer, you will see a pop-up window with the offer when logging in to your account.

The document may take some time to load, depending on the internet speed and the performance of your PC.

 

From this pop-up window, you can do the following.

  1. Accept the offer.
  2. Close the window to accept it at a later time.
  3. Open it in a different tab.

 

What if the pop-up window is empty?

Don’t worry! The document takes some time to load. If you still can’t see the offer after several minutes, refresh the page by pressing F5.

I don’t have the time to read the agreement right now. What should I do?

If you don’t have the time to read the document immediately, simply click the button in the top-right corner of the window to open it in a different tab. Then, click the “Accept later” button and get on with your lessons. Once you’re free, you can read through the agreement and accept its terms and conditions.

Please don’t put it off for too long however, as this agreement is a crucial part of our fruitful cooperation.

What if I can’t agree to specific terms and conditions of the offer?

The offer is effectively a service agreement. If you can’t accept specific terms and conditions, we will not be able to continue our cooperation.

 

How can I obtain a hard copy of the agreement?

Once you accept the terms and conditions of the agreement, you can open the document from the Finances tab of your account and print it out.

The offer contained within is a legally binding document, which confirms that a teacher is providing services for Skyeng and we remunerate them for the services provided according to the agreed-upon rates.

 

Can I provide this agreement to banks and other institutions as a confirmation of my employment?

According to this agreement, the teacher is a contractor providing services and not an employee. As is, this is an independent contractor agreement and not an employment agreement.

As per the terms and conditions of this agreement, legal relations are limited to the provision of services and receiving remuneration for the services provided without forming employee relations.
